Kindly read and understand this terms and conditions (the “policy”) carefully before using the service rendered from OKIM EXPLORER (the “OKIM EXPLORER”), or mobile applications provided by okimexplorer.com (the “site” or “website”). Products and services hereinafter referred to as “Product”. Upon usage of this website and any other form of related applications, you are legally bound and agreed to OKIM EXPLORER’s terms and conditions.

This agreement is applicable to all users of the site (the “user”), including but not limited to OKIM EXPLORER customers, clients, agents, vendors, merchants, or contributors to any form of content, materials, information and services.

1. Membership Account

To create a OKIM EXPLORER membership account, a valid email address is required. OKIM EXPLORER’s listing and services may only be used by individuals who are 18 years old and above. By registering with OKIM EXPLORER, you represent that you are at least 18 years old and all registration information submitted are accurate. In its sole discretion, OKIM EXPLORER may refuse to offer access to use the website to any individual and change its eligibility criteria at any time. Individuals under the age of 18 may use OKIM EXPLORER’s website and services only in conjunction under the supervision of a parent or legal guardian who is at least 18 years old.

You comply and agree to keep password secured and to not share with any other party. OKIM EXPLORER will not be liable to any damage due to loss of password. You may not transfer or sell your OKIM EXPLORER account or ID. You are responsible for all policies and laws applicable when using OKIM EXPLORER. Please read OKIM EXPLORER’s Privacy Policy of which is incorporated herein by reference and of which may be updated by OKIM EXPLORER from time to time without any prior notice to all users.

OKIM EXPLORER, and other OKIM EXPLORER graphics, logos, artworks, designs, service names that are visible from the website or any other promotional advertisements are OKIM EXPLORER’s registered trademarks. You may not use these trademarks about any other product or service in any manner, unless otherwise approved by OKIM EXPLORER.

2. Online Platform

OKIM EXPLORER serves as an online platform to allow users who abide by OKIM EXPLORER’s policies to purchase goods, products or services from OKIM EXPLORER. OKIM EXPLORER main service is to provide sales of furniture to users.

As a OKIM EXPLORER user, browsing websites is free of charge. Any purchase made on OKIM EXPLORER is obliged to comply with the laws and regulations stated in OKIM EXPLORER’s policies.

You need an internet connection to use OKIM EXPLORER, any lags or long buffering period is expected, depending on the speed of your internet and server service provider. OKIM EXPLORER does not promise real time accuracy, there might be cases where a product has been purchased but not displayed on OKIM EXPLORER website instantly.

3. Content and Services

All the information, which includes the content, images and descriptions, on OKIM EXPLORER represents opinion based on OKIM EXPLORER own experiences and research. Users are advised to exercise their own due diligence, judgment and discretion in assimilating the content. If any of the information that is provided by the user is found to be fictitious content or services, OKIM EXPLORER has the right to terminate the user’s account with immediate effect. OKIM EXPLORER does not hold responsibility for content added by users, and shall not be liable for any direct or indirect damages or losses caused by such content, including without limitation, copyrighted materials from other sources. OKIM EXPLORER is not liable for the accuracy of the data provided by users or third parties through the website.

You are not licensed to add any OKIM EXPLORER user to your email or physical mail list. For more information, see OKIM EXPLORER’s Privacy Policy. OKIM EXPLORER will not release or share personal information, email address and will solely be used within OKIM EXPLORER , unless otherwise stated in OKIM EXPLORER’s policies. Should you use OKIM EXPLORER’s services via a third-party application, there might be potential infringement by another party, and OKIM EXPLORER will not hold responsible for that.

4. Users Interactions and Meetups

Users shall inform OKIM EXPLORER if there are any changes on the booking, else users may receive punishment or penalty. In the event a dispute arises between you and OKIM EXPLORER, please contact OKIM EXPLORER at info@okimexplorer.com, or via whichever contact method applicable. OKIM EXPLORER has no obligation to resolve disputes between users or external parties. Should the dispute be uncontrollable, OKIM EXPLORER will refer the issue to local law enforcement.

5. Products

There are three types of products offered by OKIM EXPLORER:

●      5.2. Tour Package

●      5.3. Equipment

  • For courses that require independent study prior to the class, divers are needed to complete all knowledge reviews prior to class. Failure to do so, The Company reserves the right to postpone the entire course.

A deposit of 50% of the trip / package / course per person is required upon booking. Full payment to be made seven (07) days before date of departure or courses. A payment of deposit does not constitute the confirmation of booking or tour.

Full payment is required by the stipulated time-frame listed in the respective package price list. Failure to comply with this may result in an automatic cancellation of reservation and a forfeiture of deposit.

The course package excludes pre/post tour accommodation, laundry, unspecified meals or tours,excess baggage charge, passport and visa costs, airfare, airport taxes, personal and baggage insurance, tips and all items not listed in the tour package write up.


The administration fee will be charged in addition to any charges imposed by the airlines, hotels, tour operators, packages, credit card payment charges, etc.

A transfer to another package, at your request, does not constitute an amendment but entails the cancellation of the original booking and is subjected to the applicable cancellation fees as stated above.


In the event of any cancellation, the following cancellation fees will be levied unless specified otherwise within the product write-up. Cancellation notice charges per person is shown as the table below:

The cancellation fees will also apply to passengers not holding a valid passport or other necessary travel documents at time of departure. Deposits will be forfeited. Please take note that wrongful declaration of medical conditions that results in a cancellation will result in a 100% forfeit of course fees.

No refunds, either in part or in full, will be made for ground transportation, meals, accommodations, activities, dives, rental of equipment or sightseeing tours not taken.

OKIM EXPLORER reserves the right to cancel a booking, or suggest providing services at an alternative date in the event that conditions, including but not limited to, poor weather, acts of God, volcanic eruptions, tornado, tsunami, flood, natural disaster, fire, acts of war, riots, pandemics, epidemics, and government actions resulting from the pandemic or epidemic, or other circumstances make it unsafe or impractical to provide services at the date(s) specified in the booking confirmation.

OKIM EXPLORER has the rights and responsibility to make their own decisions as regards to offering refunds or rescheduling options when they deem a cancelation or rescheduling necessary. If a refund applies in relation to a canceled booking, the costs to be paid or reimbursed to the Customer by OKIM EXPLORER shall be limited to the actual, direct cost amounts paid by the Customer to OKIM EXPLORER in relation to the canceled booking. OKIM EXPLORER shall not be held responsible for indirect or ancillary costs such as airfare, or any other costs that are not directly related to its providing Services. OKIM EXPLORER recommends taking out private travel insurance.

5.2 Tour

For diving tours & packages, your dive certification card (C-Card) & Dive Log form part of your travel documents & verification of your dive skills. The C-Card and date of last dive needs to be provided to the Company at the time of booking without the asking by the Company. For safety measures, the supplying agents/operators reserve the right to request for this verification prior to participation. They also reserve the right to decline a participation &/or recommend a Refresher Course at additional cost & / or cancel the tour participation. In the event the passenger’s participation is declined &/or canceled, refunds will be at the discretion of the Supplying Agents / Operators.


It is the passenger’s responsibility to ensure that his/her international passport has a validity of at least 6 months prior to the date of departure and has at least 4 blank pages side by side. Relevant visas and vaccinations may be required. Cancellation charges apply for cancellation due to non-approval of VISAS or any other reasons as stated above. For Singapore permanent residents, please bring along your valid re-entry permits and other necessary documents such as Blue identity card, etc.

For foreign passport holders, it is the passenger’s responsibility to hold a valid re-entry visa/permit and other necessary documents such as valid work permit, independent pass, air ticket to the onward destination. VISA REQUIREMENTS

The Company will, wherever possible, assist you to obtain the necessary visas. Service charges and visa fees will be borne by the passenger. The Company does not guarantee the approval of the visa application. If for any reason, application for VISA(s) or exit permit(s) is rejected, the passenger will be informed accordingly. However, administrative charges and cancellation charges apply.

5.2.2. Deposit

A deposit of 50% is required upon reservation. If your minimum deposit is less than the required amount, kindly top up the difference within the next two (2) days. This deposit forms part of the final payment. Balance payment is to be paid in full to the Company seven (07) days before departure. Failure to comply with this may result in automatic cancellation of reservation and forfeiture of deposit. Payment of deposit does not constitute confirmation of the tour. All groups are subject to a minimum group size in order to depart (as determined by the company), in order for the confirmation to be effected and for the departure to be finalized.

For discounted or promotional packages, full payment is required to be done. Group tours based on special and/or promotional fares require an amount per the terms and conditions stipulated by the principal suppliers.Payment by credit card or charge card may not be applicable for certain promotional tour packages. Payment by installment plan, where applicable, is valid for selected banks and subject to banks’ approval and terms and conditions. In cases of credit card or charge card payments, refunds (if applicable) will be made through credit card or charge card companies.

Product(s) listed on OKIM EXPLORER is new to serve its purpose. Upon delivery, if the Product(s) is broken/damaged due to unforeseen situations, OKIM EXPLORER will investigate and proceed for the replacement.



Any replacement or changes of passenger will be considered as a cancellation and not an amendment. This term is applicable to all cases, including but not restricted to medical and pregnancy cases.

  • All requests must be made in writing and received by us at least 15 days prior to commencement of tour.
  • For changes to flight component of the tour, a minimum administrative fee of RM150 per ticket on top of any airline charges will be levied for any amendment, except for all special fares and promotional air tickets including tax reserved are non-negotiable, non-endorsable, non-refundable and non-reroutable. No refund will be made for any unused air ticket.

A postponement of a tour by a customer for any reason is a tour cancellation. Under such circumstances, the above Cancellation Policies will apply. OKIM EXPLORER makes reasonable efforts to avoid changes in itinerary. However, OKIM EXPLORER reserves the right to make changes at any time without compensation, especially due to unforeseen circumstances.


Refund of Deposit for cancellation – Upon cancellation, OKIM EXPLORER will refund the deposit paid according to charges stipulated on section 5.2.3. All refunds will be paid to you within two (2) weeks to a month. However, during the peak period, refunds may take around six weeks to be paid.

Refund on Tour Packages if you’re unable to confirm – OKIM EXPLORER acts as an agent for the service suppliers. After a deposit or full payment is made, all arrangements are still subject to confirmation. In the event that the reservation cannot be confirmed, OKIM EXPLORER will endeavor to notify you two (2) weeks prior to the departure date and a refund of the deposit or the tour fare will be made if the reservation is canceled as a result of the inability to confirm the reservation. In case of credit card payment, refunds will be made through the credit card company. OKIM EXPLORER shall not be liable for such cancellation, save that OKIM EXPLORER shall make the necessary refund of deposits or tour fare set out herein. All refunds will be paid to you within two (2) weeks to a month. However, during the peak period, refunds may take around six weeks to be paid.

5.3.1. Amendment

The information such as name, phone number, email address, billing address and shipping address need to be updated before the product(s) is handed over to the logistics company. The charges on the rescheduled delivery may be applied if the delivery fails due to wrong customer’s information.

5.3.2. Cancellation Refund

Users are entitled to cancel an order in less than and up to 2 days after placing the order, for which OKIM EXPLORER will refund the total paid subtotal including shipping charges, if applicable. However, the cancellation is not available once the product is with our logistics company before the request of the cancellation. User understands that in order to get any refund, it’s required to write in to info@okimexplorer.com and state the booking reference number to be canceled.

5.3.3. Warranty

OKIM EXPLORER warrants that all products be free of defective materials and workmanship. Warranty periods vary by product, commencing from the date of delivery and are defined in the table below.

Any and all products sold by OKIM EXPLORER do not come with any warranty except the original manufacturer’s warranty, where applicable. The company does not take any responsibility whatsoever in regards to warranty claims. At the company’s full discretion, we may operate to serve as a liaison between the customer and the original manufacturer of the goods where a warranty issue may arise.

Unless otherwise stated, all warranties for any product sold by OKIM EXPLORER, will be that of the original manufacturer (The Manufacturer), with some extra terms included, as stated further below.

The warranty can therefore likely be found on the manufacturers website or in any other relevant document provided by the manufacturer, or otherwise.


1) The item or items under any warranty claim are to be sent at the customer or buyer’s expense. The Company will not take any responsibility for any charges incurred by the customer when the customer makes a warranty claim.

2) The customer, when claiming under warranty, has chosen to bear the burden of having to wait for the warranty to take effect, if it does take effect at all. The company assumes no responsibility for any delay or undesirable issue of time arising from any warranty claim that has been made.

3) The Company reserves the right to change the terms of any warranty coverage that has been provided, without prior notice, and any changes made by the company are to be given immediate effect.

4) If any terms of the manufacturer’s warranty conflicts with the warranty terms stated by the company, the company’s warranty terms will prevail over any and all conflicting warranty terms that are contained in the manufacturer’s warranty.

Delivery and non-delivery of goods; insurance for goods

Any delivery of any goods by the company, by any and all transportation services, are deemed to be effectively delivered in good and merchantable condition to the receiver at the point whereby they leave the company premises. The company bears no responsibility whatsoever for any goods lost in transit, nor does the company bear any responsibility whatsoever for goods lost or damaged after they have left the company premises.

In essence, from the moment the goods are picked up from the company, either by the buyer, the transport entity or otherwise, the goods are deemed to be delivered in good and merchantable condition, and the company no longer bears any responsibility, burden, or liability in regards to the said goods.

The company does not provide any insurance whatsoever for the goods or services it provides; it is the purchaser’s responsibility to ensure they attain the insurance coverage that they may seek.

6. Charges

All product price, shipping charges (if applicable), and any other fees shall be made full payment during checkout in “Site”. There shall not be any additional payment or fees during local pickup or delivery.

7. Payment Method

Users can make payment to OKIM EXPLORER to book the products via Internet or ATM, Bank Transfer, PayPal or Stripe, which include but are not limited to the product price and shipping charges (if applicable). For payment via Internet or ATM Bank Transfer, order will not be processed until we have verified the funds have been cleared in our account. It’s the user’s responsibility to ensure the accuracy of the transferred funds, which the order ID has to be included in payment reference and the payee account as stated in email sent by OKIM EXPLORER upon checkout. OKIM EXPLORER will not be responsible for any error caused by the user or third party and the user agrees to provide accurate information.

8. Evidence of Transaction

Upon making payment for the order, a copy of order receipt along with order reference number will be e-mailed to the user as proof of transaction. An updated order receipt will be e-mailed to the user once the order has been canceled or refunded to the user’s account.

9. Authorization

If a third party is appointed or authorized to act on behalf of the user to perform any obligations stated under this policy, the authorized party must be responsible for the conduct of its appointee and liable for any loss or damage or delay caused by the appointee. Users have to inform OKIM EXPLORER with such an arrangement to avoid unnecessary mistakes. OKIM EXPLORER reserves the right to understand the situation as the user fails to collect the product(s).

12. Legal Compliance

By using OKIM EXPLORER services, you agree to comply with all legal rules stated within the country. These include taxation law, public transportation, housing, rentals and all other laws applicable. OKIM EXPLORER reserves the right to amend these policies at any time. You are deemed to accept and agree upon the revised changes made should you continue to use OKIM EXPLORER’s website and services.

13. Law, Jurisdiction, Venue

This policy and all matters relating to it will be governed by the laws of Malaysia. Both parties agree that the courts of Malaysia shall have exclusive jurisdiction to settle any dispute in conjunction with this policy. Any notices shall be delivered to a party at the addresses first listed above. The Parties are independent parties, each acting in its name and for its own purpose. Nothing in this policy shall be deemed to constitute, create, give effect to or otherwise recognize a partnership, agency, joint venture or formal business entity of any kind. Neither party may assign, modify, or amend this policy without the express written consent of the other party. If any provisions of this policy are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited to the minimum extent necessary and replaced with a valid provision that best embodies the intent of this policy so that this policy shall remain in full force and effect.
